Building on counsel’s ethical duties to stay abreast of changes in the law and technology discussed in Session I, this panel will address emerging forms of ESI associated with the newer social collaboration and communication platforms now frequently used by employees. This panel will address these new challenges related to the preservation, collection, review, and production of social collaboration data in litigation including in the increasingly popular Microsoft Office 365 environment. While the type of ESI may continue to change, the bedrock principles underlying e-discovery have not.
